Himachal Pradesh HC has ordered the attachment of Himachal Bhawan in Delhi after the state govt failed to pay nearly Rs 150 crore including 7% annual interest to Seli Hydro Electric Power Co

Justice Ajay Mohan Goel also ordered the principal secretary of multi-purpose projects and power department to conduct a fact-finding probe in 15 days.

Reacting to the order CM Sukhvinder Singh Sukhu said: “Depositing Rs 64 crore is not a big thing for the govt” and his administration would take legal measures to safeguard the state

However former Himachal CM Jairam Thakur of BJP accused Congress govt of mismanagement. “The hill state is on the verge of getting auctioned,” he said.

The legal dispute stems from a project allotted on 28 February 2009 during the BJP-led govt under CM Prem Kumar Dhumal. The state had issued a letter of allotment to Seli Hydro Electric Power Co

The project was to be implemented on a build, own, operate and transfer (BOOT) basis but the company surrendered the project on 23 September 2017 during the tenure of Congress govt under CM Virbhadra Singh citing it as “techno-economically unvi

The company approached the court on Jan 13 2023 which ordered the state government to refund Rs 64 crore with 7% annual interest from the date of filing the petition until realisation. The state appealed the decision securing a stay from the division bench on the condition of depositing the awarded amount with interest

The govt attempted to justify its actions stating that the company failed to sign an implementation contract despite multiple extensions which led to the forfeiture of the upfront premium under clause 3.6 of the pre-implementation agreement.
