Bombay High Court Issues Contempt Notice to Directors of Budhrani Housing Developers Pvt Ltd Over Redevelopment Project

The Bombay High Court has issued a contempt notice to the directors of developers-pvt-ltd" target="_blank">Budhrani Housing Developers Pvt Ltd – Shyam Sunder Agarwal, Ajay Kumar Garg, and Purshottam Chattaram Budhrani – for failing to comply with undertakings related to a redevelopment project in Andheri East.

The notice was issued following a contempt petition filed by Ashok Narang and 12 others, alleging that the developer did not adhere to the Consent Terms signed in 2017 concerning ownership of their premises in Krishna Business Park on Saki Vihar Road in Andheri East.

Justice Gauri Godse, on February 9, stated, “I am of the opinion that the respondents have committed breach of the undertakings given to the City Civil Court as recorded in the consent terms dated 30th December, 2017 in Suit No. 100812 of 2010 and accepted by the City Civil Court by order dated 12th January 2018.”

Earlier, on February 6, the High Court had directed the developer to deposit Rs7.6 crore, 50% of the outstanding amount, warning of contempt action otherwise. Despite depositing Rs7,36,29,000 by February 8, the court found a breach of undertakings.

While the developer contended that they never intended to disobey the undertakings and were willing to comply, the court noted the absence of a request for an extension of time for compliance. Consequently, the court issued a contempt notice and asked the respondents to file reply affidavits by March 8.

The court clarified that the respondents can still comply with the undertakings by depositing the remaining shortfall of Rs29,96,006, and the petitioners are entitled to withdraw the deposited amount as per the consent terms. Both parties have been instructed to submit a chart showing the proportionate amount due to each petitioner.
